Your legal requirement to use an authorised waste collection service

Under the Waste Management Act 1996, the primary responsibility for the management of any waste, including costs for collection or disposal, lies with the person in possession of the waste.   At local level, Galway County Council adopted Waste Management Byelaws in 2019 for the purpose of the proper management of waste and prevention of environmental pollution from waste.    

What are my options for properly managing my household waste?  

Under Galway County Council’s Waste Management Byelaws, you have a legal obligation to ensure that the waste from your home or business is collected by an Authorised Waste Collector.  

The Byelaws do allow for homeowners to share a bin service with a neighbour.   In this case, the homeowner must complete a Bin Sharing Form with their neighbour for submission to the Environment Department.   All payments for services must be up-to-date at any inspections of either household.  The bin sharing agreement form can be downloaded here:

The Byelaws also take into account that an individual may not be able to avail of a waste collection service and may opt to manage their waste by using a Civic Amenity Site.   In this case, the individual must be able to prove that they separate their waste into recyclable, organic and landfill waste, and keep all receipts and proof of payment to demonstrate that their waste is being managed correctly.    These must be provided on request from an Authorised Officer of Galway County Council.    

How do I arrange for a household waste collection service?  

All waste from households must be collected by Authorized Waste Collectors.   Waste Collectors must have a valid Waste Collection Permit issued by the National Waste Collection Permit Office (NWCPO).    As part of their permit conditions, all registered waste collectors must display their Permit Number on their vehicle and carry a copy of the permit in their vehicle.     You can check full permit details, including the types of waste Collectors are authorized to collect, at National Waste Collection Permit Office - Search Permits
