Noise

Guidance on noise pollution regulations, complaint procedures, and legal options for resolving noise issues.

Noise becomes a nuisance when it is so loud, so continuous, so repeated, of such duration or pitch or occurring at such times as to give reasonable cause for annoyance (Environmental Protection Agency (Noise) Regulations 1994.    

Commercial or Industrial Noise:  

Local Authorities have powers under Section 107(1) of the Environmental Protection Agency Act of 1992 to serve a notice on any industrial or commercial premises when they consider that it is necessary to do so to prevent or limit noise.    

Household Noise:  

Local Authorities do not generally get involved in disputes between households regarding noise, as any person may make an application to the District Court under the terms of the Noise Regulations 1994, to seek an Order to deal with the nuisance.   Explanatory leaflets and copies of notices to be served prior to making a complaint to the Court, can be obtained from the Environment Section.
