Taking in Charge – Completed Residential Developments

Taking in charge is a formal legal process by which responsibility for certain public areas, structures and services in a private residential development or estate are transferred to, or put in the charge of, a local authority.

Taking in Charge of a Completed Residential Development

An application for taking in charge may be made to Galway County Council once a residential estate has been completed.

When the Taking in Charge Section is satisfied that the development is satisfactorily complete, the formal statutory process begins.

What the Process Involves

The Taking in Charge process includes:

  • Initiating the procedures under section 11 of the Road Act 1993
  • Publishing a notice of the proposal giving description and map of the residential roads to be considered
  • Inviting submissions/representations from the public
  • A report is presented to the elected members for their consideration and decision

The Taking in Charge of an estate is a reserved function of the Council members.
