Part V exemption

Part V allows us to require developers to provide up to 20% of land zoned for housing for social and affordable housing.

What is Part V (Section 96)?

A Section 96 exempts a proposed housing development from the requirement to provide land for social or affordable housing.

Who can apply?

You can apply if:

  • The land is zoned for residential or mixed-use development.
  • The proposal is for 4 or fewer housing units, or
  • The site is 0.1 hectares or less in size

Restrictions

You cannot get a certificate of exemption if you have already received a Section 96 certificate in the past 5 years, unless special conditions apply.

How to apply

What you need to include

A Statutory Declaration with:

  • Ownership details of the land for the past 5 years.
  • Names of any person you're acting in concert with.
  • Any interest in nearby land (within 400 metres) you or your associates have had in the past 5 years.
  • A statement confirming you're not aware of any reason the Council should refuse the certificate under Section 97(12) of the Planning and Development Act 2000.
